Welcome to The Danubian! These terms and conditions outline the rules and regulations for the use of this website and services. By placing an order, you agree to these terms.
2. Order Process
To place an order, please navigate to the Cakes menu or contact me directly. For custom cakes, please provide details such as flavors, designs and dietary restrictions. All orders will be confirmed via email.
3. Pricing and Payment
- Pricing Information: All cake prices are clearly displayed on our website, including any applicable shipping cost.
- Payment Methods: Customers can pay by card directly on our website, via bank transfer, or by card or cash upon collection. Card payments are processed by SumUp, ensuring your transaction is secure.
- Deposit Requirement: For orders above £50, a 50% deposit is required at least 3 days before the scheduled collection date (this includes the collection day if the collection time is scheduled for 14:00 or later). Orders not paid by this deadline will be automatically cancelled.
- Orders by Post: All orders that are shipped via Royal Mail must be paid in full at the time of ordering.
4. Returns, Cancellations and Refunds
- General Returns Policy: Due to the perishable nature of our products, we do not accept returns after . All sales are final once the order is fulfilled and collected.
- General Cancellation Policy: Any order can be canceled by the customer up to 3 days before the intended collection date for a full refund.
- Deposit Requirement: For orders above £50, a 50% deposit is required at least 3 days before the scheduled collection date (this includes the collection day if the collection time is scheduled for 14:00 or later). Orders not paid by this deadline will be automatically cancelled.
- Deposit Refunds: If a customer cancels their order after paying the deposit but up to 3 days before the collection date, they will receive a full refund of their deposit. Cancellations made within 3 days of the collection date will result in the deposit being non-refundable.
- Order Completion Timing: The 3-day cancellation window includes the collection day if the collection time is scheduled for 14:00 or later.
- No Cancellation After Shipment: Once an order for post has been packaged and shipped, cancellations are no longer possible. Customers should refer to our returns policy (if applicable) for further options.
- Refusing Order Upon Collection: Customers collecting their orders in person have the right to refuse the order if they believe the quality is not up to standard or if there is an issue with the order. In such cases, depending on the situation, we may offer a partial or full refund at our discretion.
- Order Issues Upon Collection: If a customer believes there is an issue with their order at the time of collection, they should notify us immediately. We will assess the situation and may offer a replacement, partial refund, or full refund at our discretion, based on the nature of the issue.
- Returning Shipped Items: For items shipped via Royal Mail, if there is an issue with the order upon delivery, customers must contact us within 48 hours of receiving the package. Customers should provide photographs and a description of the issue and return the item at their own cost. If the reason is valid (and the item has not been excessively consumed), we may offer a refund or send a replacement free of charge at our discretion.
5. Right to Refuse or Cancel Orders
- Business Discretion: We reserve the right to refuse or cancel any order at our discretion, due to limited availability of time, resources, or any other unforeseen circumstance that prevents us from completing the order.
- Full Refund on Cancellations by Us: If we cancel an order, we will issue a full refund to the customer, regardless of whether the cancellation occurs within or outside the cancellation window described above (Cancellations and Refunds).
6. Delivery and Pick-Up
- Collection from The Danubian kitchen: Customers may collect their orders directly from The Danubian kitchen at a pre-arranged time. Please ensure prompt collection. Orders not collected by 20:00 may be canceled without refund or, at our discretion, rescheduled for a later collection time if space allows.
- Collection at Events: For convenience, customers may also collect their orders from certain events, such as local markets or fairs, where The Danubian will be present. Collection details, including event locations and times are provided during the ordering process. Customers should plan to collect their items at least 1 hour before the event ends. If items are not collected by this time, they may be offered for sale to other event attendees. Please notify us in advance if you foresee any delay in collecting your order.
- Shipping via Royal Mail: For select items, shipping is available via Royal Mail. These orders will be packaged and shipped as soon as possible after payment is received. Once shipped, please allow standard Royal Mail delivery times for arrival. Shipping fees, if applicable, will be calculated and displayed at checkout.
- Important Notes on Shipped Orders: Shipped orders must be paid in full at the time of ordering and cannot be canceled after packaging and dispatch. For further information on cancellations, please refer to our Cancellations and Refunds policy.
- Non-Collection Policy: For all pickup options, if an order is not collected by the specified time without prior notice of delay, it may be canceled without a refund. Please contact us as soon as possible if you know you will be unable to collect your order on time.
- Risk of Loss: Risk transfers to the customer upon delivery or pick-up.
7. Product Quality and Allergens
- Quality Assurance: We are committed to providing high-quality baked goods made from fresh ingredients.
- Allergen Information: Many of our products may contain common allergens, including but not limited to: gluten, dairy, eggs, nuts, and soy. We take great care to avoid cross-contamination; however, our kitchen processes may involve shared equipment. Customers with specific dietary needs or allergies should contact us directly for detailed ingredient information and advice.
- Custom Orders: For custom cakes, customers are encouraged to communicate any specific dietary restrictions or allergen concerns at the time of ordering. We will do our best to accommodate requests; however, we cannot guarantee the absence of allergens in our products.
- Customer Responsibility: It is the responsibility of the customer to inform us of any allergies or dietary restrictions when placing an order.
- Product Variations: Due to the nature of handmade products, there may be slight variations in appearance and taste from one batch to another.
8. Liability Limitation
- Limitation of Liability: To the fullest extent permitted by law, our liability for any claim arising out of or in connection with your order shall be limited to the total amount paid for the product or service in question.
- Exclusions: We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of business, or any other economic loss, arising out of or in connection with your order or the use of our products.
- Force Majeure: We shall not be liable for any failure to perform our obligations under these Terms and Conditions where such failure results from any cause beyond our reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation.
- Consumer Rights: Nothing in these Terms and Conditions affects your statutory rights as a consumer.
- Customer Responsibility: It is the customer's responsibility to ensure that our products meet their specific needs, particularly with respect to allergens and dietary restrictions. We are not liable for any adverse effects resulting from the use of our products if such concerns were not communicated at the time of ordering.

- Ownership: All content on this website, including but not limited to images, text, graphics, logos, and designs, is the property of the owners of The Danubian and is protected by copyright, and other intellectual property laws. This includes both real photographs and AI-generated images.
- Use of Images: Customers may not use, reproduce, modify, or distribute any images or content from this website without prior written permission from the owners of The Danubian. Unauthorized use of our images or content may result in legal action.
- AI-Generated Content: The AI-generated images provided on this site are created using Midjourney, and while they are the property of the owners of The Danubian, they may also be subject to the usage policies of the AI tool. Customers should not claim ownership or use these images for commercial purposes without explicit permission.
